Señales "Do Not Track". Algunos navegadores envían una señal llamada "Do Not Track".

Privacy Notice
Version 1.0 · Effective October 7, 2026.
This is an English translation of the original Spanish version. In the event of any discrepancy, the Spanish version prevails (section 13).
1. Who We Are and Who This Notice Applies To
This Privacy Notice (the "Notice") explains what personal data is collected by DE LA ROSA & CHAVEZ GROUP, LLC, a limited liability company organized in the State of New Mexico, United States, which operates under the brand Instituto de la Rosa & Chavez (the "Institute"), what it uses the data for, who it shares the data with and how long it keeps the data. The Institute is the party responsible for the personal data it collects under this Notice.
The Notice applies to the account holder (the "Account Holder"), to students, to those who request information or a trial class, and to those who visit the website or communicate with the Institute through its official channels. For the Account Holder, it forms part of the Terms and Conditions of Service (the "Terms"); it uses the same definitions as the Terms.
When the student is a minor, the Institute deals with their parent or legal guardian, who is the Account Holder. Section 7 contains the special rules for children under 13.
2. Data We Collect
The Institute collects only the data necessary for the purposes described in this Notice. The student's data is provided by the Account Holder or generated during classes and activities.
About the Account Holder:
- Name, email address, phone and WhatsApp number, city, state and country of residence, and shipping address, for the welcome package and for any prizes, gifts or recognitions the Institute sends.
- Login details for the academic management platform.
- Plan purchased and payment history. Payments are processed through an external payment processor: the Institute does not request or store full card numbers.
- Information they provide when applying for a scholarship, such as a letter of motivation.
- Messages exchanged with the Institute by email, WhatsApp and calls, including call recordings (section 4).
- Image and voice in the video calls, classes, workshops and activities in which they take part, and in the recordings of these (section 4).
- Opinions, reviews or testimonials they choose to share.
- Record of acceptance of the Terms and of this Notice, and of the consents given, with their date.
- Name and phone number of an emergency contact.
About the student:
- Name, age and date of birth, instrument, program and level.
- Image, voice and chat messages during classes and activities, and in the recordings of these, including whatever appears of their surroundings on camera (section 4).
- Videos, audio recordings, photographs or work sent to the Institute for classes, challenges, exams and other activities. These are sent by the Account Holder; by the student themselves only if the student is an adult or if the student is 13 or older and the Account Holder added them to the institutional group.
- Academic information: attendance, progress, class notes and summaries, assessments, exam results, participation in activities and the teacher's observations.
- Pedagogical profile: information the Account Holder provides about how the student learns, their attention and their study habits, in order to adapt the teaching. It does not constitute a medical or psychological diagnosis.
- Health information the Account Holder provides: injuries, conditions or medical instructions that may affect musical practice or require adaptations and, where applicable, medical clearances. This information is used only to adapt the teaching and look after the student's safety.
- City and state from which they take the class, for emergencies.
- Conduct or incident records, when they occur.
About those who request information or a trial class: name, the student's age, instrument of interest, contact details and the messages they send, and the recording of the trial class when consent is given (section 4).
About referred persons: the name and contact details provided by the person who refers them, who must have the referred persons' authorization to share them. The Institute uses them only to contact the referred persons and invite them to learn about the Institute. If they respond, their data is handled like any request for information; if not, it is deleted within the period stated in section 8.
About those who visit the website: the technical data described in section 11.
About other people present in the class or activity, such as family members or guests: their image and voice, if they appear on camera during the session.
Minors' contact details. The Institute does not ask students who are minors for their own email addresses, phone numbers or accounts: the email address and phone number on the account must be the Account Holder's. If the Institute detects that they belong to a minor, it will ask the Account Holder to replace them and will delete them from its records. The only exception is for messaging groups.
Messaging groups. Institutional groups are for the Account Holder. As an exception, and only at the Account Holder's request, a student aged 13 or older may be added to their family's follow-up group, provided the Account Holder remains in the same group; the Institute uses the student's number only within that group and removes it when the Account Holder asks. Students under 13 are not added to any group.
Accounts. Accounts on the academic management platform belong to the Account Holder. Currently, students who are minors do not have their own accounts or usernames.
Health information and pedagogical profile information are sensitive data. This data, and any data provided for a scholarship, is processed only with the Account Holder's express consent, which the Account Holder gives by accepting this Notice.
The Institute does not collect biometric data or use technologies to identify people by their face or voice.
3. What We Use the Data For
The Institute uses personal data to:
- Handle requests for information, contact referred persons, and schedule, hold and follow up on the trial class.
- Enroll the student, assign their group, schedule and teacher, and deliver the classes and activities.
- Track academic progress and adapt the teaching to each student.
- Send the welcome package and, where applicable, prizes, gifts or recognitions from the Institute's activities.
- Process payments, renewals, plan changes, cancellations and refunds.
- Evaluate scholarship applications and administer the scholarships granted.
- Communicate with the Account Holder about the service: notices, reminders, changes, confirmations and congratulations.
- Look after the safety of students and handle complaints and incidents.
- Review the quality of classes, give feedback to teachers and improve the Institute's programs.
- Contact the Account Holder or the emergency contact in the event of an emergency during class, in accordance with the Terms.
- Verify compliance with the Terms and prevent fraud or misuse of the service.
- Comply with legal, tax and accounting obligations, and exercise or defend its rights.
- Recognize and publicize students' activities, in accordance with section 5.
- Provide information about the Institute's programs and promotions to the Account Holder, to families who were previously enrolled and to those who requested information or a trial class, by email, WhatsApp or phone. Any of them may ask at any time to stop receiving these messages.
Promotions and the publications described in section 5 are not necessary to provide the service: the Account Holder may refuse them at any time, without this affecting the service. The Institute sends promotional messages only when the law of the recipient's place of residence allows it, and asks for consent beforehand when that law requires it.
If the Institute needs to use the data for a different purpose, it will give notice beforehand and, when required by law, will ask for the corresponding consent.
The Institute does not use the data of students who are minors to direct advertising to them or to build profiles for commercial purposes.
The Institute may use information that does not identify any person, such as statistics or achievements reported without names, to improve its programs and make them known.
4. Recordings of Classes, Trial Classes and Calls
Classes. Live classes are recorded, barring technical failures. Recordings are used so that the student can review the content, to provide transparency to the Account Holder and track academic progress, and for quality control, student safety, handling of complaints and legal compliance. Other online activities, such as workshops, exams and recitals, may also be recorded and are governed by the same rules.
Each recording is available for up to 15 calendar days, exclusively for viewing by the student and their family, through the means the Institute designates. In group classes, the recording shows all participants and is available to the families of all students in the group. The Terms prohibit downloading or sharing recordings, but the Institute cannot technically prevent someone from capturing them. Afterwards, the Institute may keep the recording as an internal backup, with restricted access, for the periods in section 8.
Automatic summaries. The videoconferencing platform may automatically generate, using artificial intelligence tools, a transcript and a summary of the class. The teacher uses the summary as an aid in writing the follow-up note that the Institute shares with the Account Holder. The Institute does not use class recordings to train artificial intelligence models.
Other people on camera. People who are not enrolled students must, as far as possible, remain off camera. If they appear during the session, their image and voice may be included in the recording and are treated in the same way. Under the Terms, the Account Holder is responsible for the people present in their surroundings and for informing them that the session is recorded.
Trial class. The trial class is recorded as a record of the information presented about the program, its conditions and any agreements reached. At the start, the verbal consent of the parent or guardian, or of the adult student, is requested; if it is not given, the session is held without recording. The recording is for internal use only: it is not published or shared with third parties, except when necessary to address a complaint, a dispute or a legal request.
Calls and video calls. Calls for administrative, pedagogical or follow-up purposes may be recorded, and notice of this is given at the start. Anyone who prefers not to be recorded may request this before or during the call, without affecting their access to the service.
The Institute does not publish recordings of classes, trial classes or calls. What may be published from classes and activities is described in section 5.
5. Use of Image and Publications
The Institute publishes content on its social media and official channels for educational, promotional or recognition purposes, under these rules:
Anonymous content. The Institute may publish photographs, screenshots or short video clips of classes and of any activity, provided that the student cannot be identified in them: with their face hidden or blurred, without their name or speaking voice, and without any element that would allow them or their home to be recognized. For example, hands on the instrument or the music performed may be shown. For students under 13, their voice, whether speaking or singing, is not published either without the consent described below. Only anonymous content is published from classes. The Account Holder may request at any time that no clip in which the student appears be used, and the Institute will remove those already published within a reasonable time.
Identifiable content from activities. From recitals, competitions, challenges, workshops, award ceremonies and presentations of diplomas, prizes or recognitions, the Institute may publish screenshots, photographs, names or videos of students:
- Adult students: with the consent they give by accepting the Terms. They may withdraw it or ask not to appear, in writing, before the event or activity. They may also ask afterwards that a publication be removed; the Institute will remove it or edit it so that they do not appear, within a reasonable time.
- Students aged 13 to 17: only with a separate permission, from both the Account Holder and the student, which the Institute requests as a separate question and not as part of the acceptance of the Terms. Either of them may refuse it without this affecting the service, withdraw it at any time, or ask that a publication be removed; the Institute will remove it or edit it so that the student does not appear, within a reasonable time.
- Students under 13: the Institute does not publish faces, voice, names or other identifiable information unless, before publication, it obtains the verifiable consent of the parent or guardian, by recorded video call. That consent may be withdrawn at any time, and the Institute will remove the corresponding publications from its official channels within a reasonable time.
Other uses. For any other use, such as testimonials or reviews, the Institute requests additional written consent.
Events with guests. At events open to guests, attendees may watch and, in some cases, record or capture the performances. The Institute asks them not to share the image of other students, but cannot control recordings or publications made by third parties. Registering for an event implies acceptance of these conditions; anyone who does not agree may choose not to take part. Whether the Institute later publishes the student's image, voice or name is governed by the rules above.
Participating or not in publications is never a condition for receiving the service or for obtaining or keeping a scholarship. Content removed by the Institute may remain in copies made by third parties or on the platforms themselves, over which the Institute has no control.
6. Who We Share Data With
The Institute does not sell personal data or share students' data for advertising purposes. The browsing data of those who visit the website may be shared with advertising platforms, as described in section 11. Apart from that, it shares personal data only with:
- Teachers, staff and collaborators of the Institute, such as guest judges or guest workshop leaders, who access only the information necessary for their roles.
- Service providers that process the data in order to provide their service to the Institute, in accordance with their own terms and privacy policies: videoconferencing and recording, cloud storage, payment processing, academic management and scheduling, messaging and email, forms, website hosting, and document preparation tools, including artificial intelligence tools.
- Publishers, merchants, and printing and courier services, which receive the name, the shipping address and, when the shipment requires it, a contact phone number, in order to deliver the welcome package and the prizes, gifts or recognitions. Shipments are addressed to the Account Holder. Their contents, such as a congratulatory note or a diploma, may include the student's name.
- The financing provider, when the Account Holder chooses that form of payment. Its relationship with the Account Holder is governed by that provider's terms and privacy policy.
- Families in the same group and participants in the same activity, who see the student's image, voice and name during the class or activity and in its recordings (section 4). If the Account Holder takes part in an institutional messaging group, the other members can see the Account Holder's name and number. A student aged 13 or older is added only to their own family's follow-up group, together with their teacher and the Institute.
- People authorized by the Account Holder, such as another family member or the emergency contact.
- The public and guests at events, only with respect to content published or presented in accordance with section 5.
- Emergency services and authorities. In an emergency during class, the Institute may share with them the information strictly necessary. It may also share data when required by law, to respond to a valid legal request, to protect a person's safety, or to exercise or defend the Institute's rights in a complaint, a dispute or a proceeding.
- Professional advisers, such as lawyers, accountants or insurers, when necessary and under a duty of confidentiality.
- A successor to the business. In the event of a restructuring or transfer of the business, the data may be transferred to the new owner, which must respect this Notice.
By accepting this Notice, the Account Holder agrees that the data may be shared as described in this section.
Activities on external educational platforms. The teacher may share links to games or exercises on third-party educational platforms. The student does not register or provide their email address or other personal data: they take part as a guest or with an account created and managed by the Institute, and may be asked only for a nickname, which must not be their full name. The Institute does not provide the student's data to those platforms, which may collect technical data from the device in accordance with their own privacy policies. Use of these platforms is optional.
7. Children Under 13
The Institute does not knowingly collect the personal data of a student under 13 without the verifiable consent of their parent or guardian.
What is collected and how it is used. The data collected about the child is the data listed in section 2 under "About the student", for the purposes in section 3. The Institute does not require more data than is reasonably necessary for the student to take part in classes and activities. The service does not allow the student to make their personal information public: there are no profiles, forums or posts by students.
Who it is shared with. The child's data is shared only with the people and categories in section 6. Sharing the class and its recording with the families in the same group is an integral part of the group service. Publishing the child's image, voice or name in an identifiable way is not: it always requires separate consent (section 5), and the Account Holder may accept the service without giving it. The child's participation in events with guests is confirmed with the Account Holder for each event.
How consent is obtained. Before collecting data about the child, the Institute provides this Notice to the Account Holder and obtains their consent by one of these means:
- Acceptance of the Terms and of this Notice together with a payment by card or other online payment method that notifies the account holder of each transaction.
- A video call with Institute staff, when enrollment does not require payment, for the recording of the trial class and for the publication of identifiable image or voice.
Rights of the parent or guardian. At any time, they may:
- Review the child's personal data that the Institute holds.
- Ask that it be corrected or deleted.
- Refuse to allow it to continue to be collected or used.
To exercise these rights, they must write to info@institutodelarosaychavez.com or by WhatsApp at +1 (646) 583-3326. The Institute will verify the identity of the person making the request and that they are the child's parent or guardian, and will handle the request within a reasonable time, which will not exceed 45 days or any shorter period set by applicable law. If the data is necessary to provide the service, deleting it or refusing its further collection may result in termination of the membership.
The Institute may keep the records that the law requires it to keep, such as payment and consent records (section 8).
Deletion of recordings. Because classes are held in groups, a request to delete a recording is handled by deleting the entire recording of that class. Recordings related to an incident, a complaint, a claim, an investigation or a proceeding are kept for the periods in section 8.
If the Institute discovers that it collected the data of a student under 13 without the required consent, it will delete that data.
8. Retention Periods
The Institute keeps personal data only for as long as necessary for the purpose for which it was collected and then deletes it or makes it anonymous. It does not keep the data of children under 13 indefinitely. The following periods are maximums: the Institute may delete the data sooner. Deletion from providers' backup copies may take longer to complete. Each item states the data, what it is kept for and for how long.
Prospects and referrals
- Those who request information or a trial class and do not enroll: to coordinate the class, follow up and send information about the Institute. Up to 3 years from the person's last contact with the Institute, or sooner if they ask to stop receiving messages.
- Referred persons who do not respond: to contact them and invite them to learn about the Institute. Up to 12 months from when their data was received.
- Those who asked not to receive messages: to honor their request. Only their contact detail, for as long as necessary for that purpose.
Recordings
- Trial class: a record of what was presented and agreed. If the student does not enroll, up to 12 months. If the student enrolls, while they are enrolled and for up to 12 months after their enrollment ends.
- Classes, access by the student and their family: review, transparency and academic tracking. Up to 15 calendar days.
- Classes, internal backup: quality control, student safety, handling of complaints and legal compliance. Up to 12 months.
- Classes and records related to an incident, a complaint or a dispute: to handle and document the case and defend rights. Until it is resolved and for up to 2 additional years or, if they involve a minor, until the minor turns 21, whichever is later. If a claim, investigation or proceeding is pending, for as long as it lasts.
- Calls: quality, transparency and safety. While the membership is active and for up to 12 months after it ends; those of people who do not enroll, up to 12 months. Those related to a complaint or dispute, until it is resolved and for up to 2 additional years.
Student data
- Name, date of birth, academic information, pedagogical profile, health information and emergency contact: to deliver and adapt the teaching. While the student is enrolled and for up to 12 months after their enrollment ends.
- Videos, audio recordings and photographs sent for classes, challenges and activities: to give feedback, follow up and recognize participation. Up to 12 months from when they were sent. Those that are published are governed by section 5.
Account Holder data
- Contact details, scholarship information and messages exchanged: to provide the service, handle requests for clarification and send information about the Institute. While the membership is active and for up to 3 years after it ends.
- Records of payments, of acceptance of the Terms and of consents: tax and accounting obligations, and to prove what was accepted. Up to 7 years from their date.
Published content
- Images and published content: recognition and publication. For as long as it remains published; it is removed in accordance with section 5. Content that shows a student under 13 in an identifiable way is removed no later than 3 years after its publication.
If the parent or guardian of a child under 13 requests early deletion of the child's data, section 7 applies.
9. Security
The Institute applies reasonable administrative, technical and organizational measures to protect personal data, appropriate to its size and to the sensitivity of the information, especially that of minors. Among them, it limits access to information to those who need it for their roles.
No system is completely secure, and the Institute cannot guarantee the absolute security of the information. If a security incident affecting personal data occurs, the Institute will notify those affected when required by law.
The Account Holder also helps protect the information: they must keep their passwords and the links to classes and recordings private.
10. Your Rights and Choices
The Account Holder, and any person whose data the Institute holds, may at any time:
- Request access to, correction of or deletion of their personal data and, in the case of the Account Holder, the data of the student they enrolled. The Institute may keep the data it needs to comply with legal obligations, resolve disputes or enforce its agreements, for the periods in section 8.
- Object to uses that are not necessary for the service, such as promotions and publications.
- Withdraw a consent already given. Withdrawal does not affect what was done before; if that consent is necessary to provide the service, it may not be possible to continue the membership.
- Stop receiving promotional messages. The opt-out is applied within a maximum of 10 business days. Notices necessary for the service, such as confirmations, charges and changes, will continue to be sent.
- Ask not to be recorded on a call (section 4).
- Decide on the use of image (section 5).
Requests are submitted to info@institutodelarosaychavez.com or by WhatsApp at +1 (646) 583-3326. The Institute will verify the identity of the person making them and will handle them within a reasonable time, which will not exceed 45 days or any shorter period set by applicable law.
If a request is made to delete data that is essential to provide the service, it may not be possible to continue the membership.
11. Website, Cookies and Advertising
Website. The Institute's website presents its programs and services and is directed to adults: it does not request data from minors. It may include access to the portal of the academic management platform, which is operated by that provider and is intended for the Account Holder. When the site is visited, the hosting service and other technical providers of the site automatically log technical data, such as the IP address, the type of device and browser and the pages viewed; this data is used to operate and protect the site. The WhatsApp button opens a conversation in that application, which is governed by its own policies.
Forms. When a visitor fills out a form on the site, for example to request a trial class, the Institute collects only the adult's contact details and the student's basic data listed in section 2.
Cookies and similar technologies. The site may use cookies and similar technologies, its own or those of its providers, to function, to measure how it is used and for the advertising described below. Those that are not necessary for the site to function are activated only if the visitor accepts them in the cookie notice, and the visitor may change their choice at any time. The site may display content from other providers, such as videos, maps or calendars, which loads only with the visitor's acceptance or when the visitor requests it. If the Institute sends informational emails, these may include technologies that indicate whether they were opened and which links were used.
Advertising. The Institute advertises on social media and may advertise on other online platforms, such as search engines, with campaigns directed to adults. With the visitor's acceptance, the site may use tools from those platforms, such as pixels, which tell those platforms which pages a person visited and whether that person requested information, in order to measure the ads and show the Institute's advertising to those who have already visited the site. Those platforms may combine that information with the person's activity on other sites, in accordance with their own policies. The Institute configures these tools so that they do not receive students' data, and does not provide lists of customers or prospects to advertising platforms.
Social media and messages. The Institute has official accounts on social media. What a person posts or sends there is also subject to each platform's policies. If someone writes to the Institute through those channels or responds to an ad, the Institute uses their profile name, their messages and the phone number they provide in order to assist them, in accordance with sections 2 and 3. The first reply may be an automated message.
"Do Not Track" signals. Some browsers send a signal called "Do Not Track". The site does not respond to that signal; cookies that are not necessary are activated only if the visitor accepts them.
12. Where Data Is Processed
The Institute is a United States company and provides its service online. Its staff, its teachers and some of its providers may be located outside the United States and outside the Account Holder's country of residence. For this reason, personal data may be processed or stored in the United States and in other countries, whose data protection laws may be different from those of the Account Holder's place of residence. The Institute remains responsible for that data under this Notice, regardless of the country from which its staff and teachers process it. By accepting this Notice, the Account Holder agrees that their data and the student's data may be processed in this way.
13. Changes to This Notice
The Institute may change this Notice. The Account Holder will be notified of important changes, such as those that change what data is collected, what it is used for or who it is shared with, at least 15 days in advance by email or WhatsApp; other changes will be published with their new effective date. When required by law, the Institute will also ask for consent before applying the change. If a change involves collecting, using or sharing the data of a child under 13 in a way different from the one their parent or guardian consented to, the Institute will ask for a new consent before applying it. An Account Holder who does not agree with a change may cancel their membership in accordance with the Terms.
Changes to this Notice are governed by this section. Each version is published with its effective date, and previous versions are kept on file. This Notice may also be published in English; in the event of any discrepancy, the Spanish version prevails.
